PatioHub — Terms of Service

These Terms of Service ("Terms") form a legal agreement between you and Wesley Fischer trading as PatioHub ("we", "us", "our"), an Australian sole trader business.

By creating a PatioHub account, downloading our mobile app, or using our services, you agree to be bound by these Terms.

1. What PatioHub does

PatioHub is a mobile app and web service that lets you:

  • Design a patio for your property
  • See an AI-rendered preview of that design on a photo of your real install area
  • Receive an itemised quote for your design
  • Reserve your spot in our build pipeline as either a DIY kit or a Supply & Install order
  • Schedule a final on-site measure
  • Take delivery of materials or have us build the patio for you

You can use the design and render features for free. Paid services begin when you reserve a spot and we issue you an invoice.

2. Eligibility

To use PatioHub you must:

  • Be at least 18 years old
  • Be an Australian resident with a valid Australian address
  • Have legal authority to authorise improvements at the property where the patio will be installed (e.g., as homeowner, or as authorised tenant with owner's consent)

3. Your account

  • You must provide accurate, current information when you sign up.
  • You're responsible for keeping your password secure. Tell us immediately if you suspect unauthorised access.
  • One account per person. You may not share accounts.
  • We may suspend or terminate your account if you breach these Terms, attempt fraud, or abuse the service.

4. Quotes

4.1 Indicative pricing

Quotes shown in the app are indicative and based on the dimensions and selections you enter. Final pricing is confirmed after our on-site final measure.

4.2 Validity

Quotes are valid for 14 days from issue unless extended in writing. Prices may change if:

  • The on-site measurement differs from what you entered
  • You request changes to the spec
  • Material costs change between quote and manufacture (rare, but possible)

If pricing changes, we'll notify you and you can approve, adjust, or cancel without penalty.

4.3 GST

All prices include 10% GST unless stated otherwise. Tax invoices issued on payment.

5. Reservations and payment

5.1 Reserving a spot

Reserving your spot requires a flat $250, invoiced after you reserve and payable by card or bank transfer. It holds the price you were shown and books a licensed builder to come out and measure your site.

Reserving is not a binding order. Your job is only confirmed once the on-site measure has been done and you have approved the final scope and price. The $250 is the only money that moves before a builder has been to your place, and it is a flat fee — never a percentage of the job.

We'll contact you within 1 business day of your reserve to book the measure.

5.2 The $250 reserve is your measure fee

Your $250 is:

  • Fully refunded if you cancel before the on-site measure has taken place (within 5 business days of you telling us)
  • Retained by us if you cancel after the measure has taken place — it has paid for a licensed builder to attend your property and measure it
  • Credited toward your total if you go ahead

5.3 Final payment

Balance is invoiced after the final measure, payable within 7 days of invoice. Manufacturing does not start until payment is received in full.

Once manufacturing begins, payments are non-refundable — kits are custom-cut to your dimensions. For DIY kits, full payment is due before manufacturing begins.

5.4 Payment methods

We currently accept payment via bank transfer or the card-payment link on our invoices. We will provide these details on each invoice. PatioHub does not store your card details — card processing is handled by our invoicing provider.

6. The on-site measure

Before any patio is manufactured, we (or our authorised contractor) will visit your property to take final measurements and confirm site conditions.

  • The measure is included in your quote — no separate charge unless you cancel after the visit.
  • You must provide reasonable access to the install area.
  • If the site is unsafe or substantially differs from what was shown in your reserved design, we may need to re-quote.

7. Manufacturing and delivery

7.1 Lead times

Typical lead times:

  • DIY kit manufacture + delivery: 2–4 weeks from final payment
  • Supply & Install: 4–8 weeks total from final measure

These are indicative. We'll give you a real ETA after final measure.

7.2 Delivery

DIY kits are delivered by freight to your address. Someone over 18 must be present to receive. Delivery is to a single drop-off point on your property — we do not unload to the install location unless specified.

7.3 Install (Supply & Install only)

Our crew will arrive at the agreed date with all materials. Typical install: 3–8 days depending on size and access. You don't need to be home, but reasonable access (gate, etc.) must be arranged.

8. AI rendering disclaimer

The AI-generated renders shown in the app are artistic visualisations, not engineering drawings. We do our best to make them accurate, but:

  • The render is for visualising design intent — the final patio is defined by the itemised quote, not the image
  • Renders may exaggerate or miss real-world site conditions
  • Colours, textures, and materials in the render may differ slightly from the actual installed product

If you have specific concerns about an aspect of the render, raise them before you reserve.

9. Warranties

9.1 Manufacturer's warranty

All materials carry the original manufacturer's warranty, which we will hand over to you on completion. Typical:

  • Insulated panel roofing: 15-year structural, 10-year colour
  • Colorbond steel: 25-year corrosion warranty (subject to environment)
  • Hardwood timber: 10-year structural
  • Polycarbonate: 10-year manufacturer warranty

9.2 Workmanship warranty

For Supply & Install orders we provide a 5-year workmanship warranty on our install labour from the date of practical completion. Excludes wear and tear, damage from severe weather, modifications by third parties, or misuse.

9.3 DIY kits

DIY kits come with the material warranties only — workmanship is your responsibility (or your installer's).

9.4 Statutory rights

Nothing in these Terms limits your rights under the Australian Consumer Law. You are entitled to a refund or replacement for major failures and compensation for foreseeable losses.

10. Cancellation

10.1 By you

  • Before reservation: no obligation either way
  • After reservation, before measure: full refund of your $250 reserve
  • After measure, before manufacturing: we retain the $250 (it paid for the measure); any further payments are refunded in full
  • After manufacturing begins: non-refundable, but we'll work with you on changes where possible

10.2 By us

We may cancel an order if:

  • The site is unsafe or unsuitable for the design
  • You're materially uncontactable for 30+ days
  • The design violates local council requirements that can't be reasonably addressed
  • We discover fraud or misrepresentation

In any cancellation by us, we will refund all payments within 5 business days.

11. Your obligations

By using PatioHub you agree to:

  • Provide accurate information about your property, the install area, and yourself
  • Confirm with your local council whether your design requires a building permit — we will help if asked, but final responsibility rests with you
  • Disclose anything unusual about the install area (underground services, easements, awkward access, unique zoning)
  • Pay invoices on time
  • Treat our staff, installers, and customer service team respectfully

12. Acceptable use

You agree NOT to:

  • Use PatioHub for any unlawful purpose
  • Reverse-engineer, scrape, or copy the app or website
  • Misrepresent yourself or another person
  • Upload offensive, illegal, or copyrighted material as your site photos
  • Attempt to disrupt, hack, or overload our systems
  • Use PatioHub to compete with us or build a competing product

Breach of these clauses can result in immediate account termination and legal action where appropriate.

13. Intellectual property

  • PatioHub owns the app, website, design tools, and all underlying software and trademarks.
  • You retain ownership of the photos you upload and the patio that gets built for you.
  • By using the AI render feature, you grant us a non-exclusive licence to process your uploaded photos via Google Gemini and to display the resulting render to you and to PatioHub admin staff.
  • We may, in anonymised + aggregated form, use your renders to improve the service.

14. Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages (e.g., lost business, lost data, emotional distress) arising from your use of PatioHub.
  • Our total liability to you under these Terms (excluding statutory rights) is capped at the total amount you have paid us in the 12 months preceding the claim.
  • Nothing in this clause limits any non-excludable consumer guarantees under the Australian Consumer Law.

15. Disputes

We hope you never have a problem with us. If you do:

1. Talk to us first. Email hello@patiohub.com.au with subject "Dispute". We'll respond within 7 days.

2. Mediation. If we can't agree, we'll suggest a free or low-cost mediation service (e.g., your state's Office of Fair Trading).

3. Litigation. If mediation fails, disputes are governed by the law of [your state — likely NSW or QLD] and brought in a court of competent jurisdiction in that state.

16. Changes to these Terms

We may update these Terms occasionally. Material changes will be:

  • Posted at patiohub.com.au/legal/terms with a new "Last updated" date
  • Sent to your account email at least 30 days before taking effect

If you continue using PatioHub after a change takes effect, you accept the new Terms. If you don't agree, you can close your account before the effective date.

17. Severability

If any clause in these Terms is found to be unenforceable, the remaining clauses continue to apply.

18. Entire agreement

These Terms, together with our Privacy Policy, form the entire agreement between you and us regarding PatioHub. They override any prior agreements, oral or written.
